RIP Judge Rehnquist...native of Milwaukee, WI.

I'm not going to even comment or guess what the left will do about this one...I am way to disgusted by how they are trying to turn the hurricane aftermath into a lifetime support from the black community. I truly hope people with common sense and any amount of decency can see what they are doing, and remember it on election days for many years to come.

I have to say that Rehnquist's finest moment was his handling of the Clinton impeachment trial. He seemed determined to manage the trial with decorum and honor.

His lowest moment was probably when he almost certainly lied during his confirmation hearing. This is from Edward Lazarus'review of John Dean's The Rehnquist Choice:

Dean's indictment of the Chief Justice focuses on his confirmation testimony about a memo that Rehnquist had written while a law clerk to Justice Jackson during the Court's consideration of Brown v. Board of Education.

In the memo, entitled "A Random Thought on the Segregation Cases," Rehnquist wrote, in part: "I realize that it is an unpopular and unhumanitarian position, for which I have been excoriated by 'liberal' colleagues but I think Plessy v. Ferguson [establishing the doctrine of "separate but equal"] was right and should be affirmed."

For obvious reasons, this memo's opposition to the result reached in Brown presented Rehnquist with a confirmation problem. But he came up with a fairly ingenious solution. Rehnquist claimed that the memo did not embody his own views. Instead, Rehnquist claimed to have prepared the memo at Jackson's request "as a rough draft of a statement of his [Jackson's] views."

As Dean parses with great care, this explanation does not hold water. The Rehnquist memo's reference to having "been excoriated by 'liberal' colleagues" makes no sense in the context of a statement of Jackson's views to be delivered to his colleagues. On the other hand, it makes perfect sense in the context of an expression of Rehnquist's views — as Rehnquist, by his own admission, saw himself as a lonely conservative clerk isolated in a sea of liberals.

(Indeed, though Dean does not mention it, Rehnquist made a similar complaint about liberal colleagues in a bench memo in another race discrimination case, Terry v. Adams. There, Rehnquist wrote —clearly in his own voice — "It is about time the Court faced the fact that the white people [in] the South don't like colored people.")

In light of Dean's analysis of Rehnquist's veracity, one is led in "The Rehnquist Choice" to a devastating conclusion. In the end, Rehnquist embodies Nixon's legacy in at least two respects. Strict constructionist as he himself defined it, Rehnquist alone among Nixon's four appointees stayed true to Nixon's politically conservative hopes for the Court. And, like the man who appointed him, Rehnquist's conduct has tragically advanced the steady erosion of the integrity of our institutions of government.


But his darkest moment was his participation in Bush v. Gore 2000 which is the most activist court decision in Court history. Following no precedent and specifically denying any future precedent he presided over a case in which the SCOTUS had no jurisdiction yet decided it contrary to any established judicial logic or case law.

are you still complaining about Florida 2000...the election not even the liberal media outlets could come to a conclusion that Gore won anyway they counted the votes...

the election where the left wanted to only count certain votes over again...

keep it up...it makes me more confident that the left will never win a national election again...even though you have only won two since 1980.

But no matter who Bush puts up, they are going to be filibustered......And I'm glad. Put the (D)'s out there for everyone to see. --> And one particular (R), too.

If they do, then Frist must force the nuclear option......And then we'll see what Sen. McCain has in his pants.

If he stands on his previous "commitment" to screw the (R)'s he'll throw away any chance at the Presidency in 2008.

If he sticks it to the (D)'s he'll write his ticket to the job.

the problem with the justice thing is...conservatives are put on trial for being conservatives...they are guilty of that crime, and then must prove that they won't be too conservative...ginsburg is a crazy ACLU whacko and she was confirmed 97-3.

Chief Justice Rehnquist was a saint who never made a wrong decision, was never on the wrong side of a case, never lied, and was always above any question as to judgement or motive.

There is no reasonable controversy regarging the 2000 presidential election. Every legal vote was counted. Every person who legally voted was allowed to vote. The person who was responsible for running the Florida election and certifying the count was totally fair and non-partisan even though she was the chairperson of the Florida Bush-Cheney campaign.

Anybody who suggests anything otherwise is a liberal lunatic who should forever keep his mouth shut and remain outside the electoral process.

So help me God!

According to Orrin Hatch, he himself suggested that "crazy ACLU wacko" Ginsburg to Clinton as well as Breyer.

From Hatch's autobiography:

I asked whether he had considered Judge Stephen Breyer of the First Circuit Court of Appeals or Judge Ruth Bader Ginsburg of the District of Columbia Court of Appeals. President Clinton indicated he had heard Breyer’s name but had not thought about Judge Ginsberg.

I indicated I thought they would be confirmed easily. I knew them both and believed that, while liberal, they were highly honest and capable jurists and their confirmation would not embarrass the President. From my perspective, they were far better than the other likely candidates from a liberal Democrat administration.


Hatch was the ranking member of the Judiciary Committee at the time. Will Bush consult Biden? If he accepts Biden's suggestion, he'll probably get 97-3, too.

Conservatives are not put on trial for being conservative. They are questioned so as to make known the extent and possible ramifications of their conservative philosophies.

I think Roberts will and probably should be confirmed. The president has the right to appoint a conservative justice. By the same token, the public has a right to know what that conservatism really means--what it means beyond the abortion and gay rights issues and into federalism, states' rights, federal and state regulation, and interstate commerce.

every vote was not counted in 2000...Gore had a lot of military votes thrown out.

Not accurate. Gore's team attempted to exclude military ballots that did not have post marks (a technical requirement) just as Republicans fought to exclude on technical grounds ballots which clearly showed voter intent. Gore's team of incompetent lawyers lost.
