This is how kids are nowadays.
They believe they can do whatever they want, and not even the police can tell them what to do.
Think about how hard it is for a teacher to get kids to follow directions.
I don't know if it is as bad in the burbs, but in the inner city kids will not even think about listening to you if they do not feel like it.
There is NO WAY they will give you a cell phone or ipod.
It gets tiring and many teachers give up trying to confiscate these items...let alone trying to get kids to do actual work.

cell phones are STRICTLY forbidden in nyc public schools, and is strictly enforced...every year, like clockwork, parents and/or legal eagles petition courts and city council, only to see the policy upheld...
it will be debated forever! as long as the debate rages on, with the ban in effect
the classroom is no place for cell phones
here, suburban districts are generally far more lax, but all have a policy of some sort, that is adhered to, in varying degrees
