HIV sufferer jailed for unprotected sex

This is very interesting.
Should the person be arrested?
Is it their "right" to do what they want with their body?
Shouldn't they be free to "choose" what they do?
When does it change from personal behavior to a menace to society?
Where is the line?

I don't know about Australian law, but, if he knew he was infected with HIV and willfully refused to take precautions (as we know them) to protect their partner, yes, they should...

If I say stabbing my neighbor will definitely not cause his death, the fact that he has diabetes will kill him, and I do it, should I get off the hook? I think not?

Yep...and then they should masturbate. But if they want to have sex with someone else and be deceptive about their own health, that's wrong, almost like murder.

Again, if it's someone else they're involved with, that someone else has an equivalent right to make an informed choice for themselves...

When you get someone who willingly has sex with someone else without informing them, or deliberately to expose them to the virus...

I would think that, out of common decency, if you have any of these disorders, you have a moral obligation to clearly inform any spouse, partner, etc., before you even really get that close, but I don't know enough about any of these maladies to say if this is practical or not.

I guess the reason why HIV would be set apart is that it kills...

I would think a person who unwittingly contracts one of the other illnesses would have the right to sue for damages, no?

Scorpion could pretty easily win a civil suit against PCD by showing that PCD knew that he was infected before they had sex.

Set the sentence according to the persons demonstrated believes.
If he doesn't think that another persons life is worth more than a few moments of pleasure, why should we spend a lot of money on jail or on his medicines.
Sentence him according to his own principles, you cannot be more democratic.
Here in Sweden, the lawyers have found a paragraph that says that if a person doesn't die within some stipulated time after an assault it isn't murder.
But that was only intended in case of an physical attack, but is used anyway because with medicines it takes a little longer to die from AIDS.
A completely rotten justice !
